On 1st January 2013 MARPOL Annex V requirements for the prevention of pollution by garbage from ships entered into force.
The new Annex requires that the discharge of all garbage into the sea is prohibited, except as expressly provided otherwise. The discharges permitted while en route include food wastes, cargo residues and water used for washing deck and external surfaces containing cleaning agents or additives which are not harmful to the marine environment. However there is an exception to the “en route‟ requirement with the discharge of food wastes where it is clear the retention on board presents an imminent health risk to the people on board. There has been no change to the limited exceptions to the regulations in the case of emergencies and accidental loss.
There are several new definitions in the revised Annex including- animal carcass(es), cargo residues, cooking oil, domestic wastes, fishing gear, food wastes, incinerator ashes, operational wastes and plastics. All of these definitions are now incorporated in the revised general description for “garbage‟.
Vessels Over 100gt
All vessels (including yachts) over 100 gross tonnage (gt) are required to carry Garbage Management Plans. (Previously this applied only to vessels over 400gt). The Garbage Management Plan should be based on the guidelines developed by the International Maritime Organisation (IMO).
Vessels over 400gt
All vessels of 400 gross tonnage and above and every vessel certified to carry 15 persons or more, and every fixed or floating platform engaged in exploration and exploitation of the seabed, must provide a Garbage Record Book, to record all disposal and incineration operations. The date, time, position of ship, description of the garbage and the estimated amount incinerated or discharged must be logged and signed. The books must be kept for a period of two years after the date of the last entry.
